Global Health Council is the leading global organization committed to enhancing global health priorities by uniting policymakers, advocates, implementers, and other stakeholders. 2. Select and analyze a public health law that impacts your nursing practice in relation to Gostin and Wiley’s five characteristics of public health law.
One of the public health laws in Texas, is the law on Disclosure of Health Care Information. The law states that a hospital or an agent or staff of a hospital may not disclose health care information about a patient to any individual other than the patient or the patient’s legally authorized representative without the written authorization of the patient or the patient’s legally authorized representative (University of Houston law center, n.d.). The law impacts my nursing practice in the ER where we have a large patient volume and patients present in conditions requiring emergency care.
In the ER patient are often accompanied by their families, friends, colleagues, or strangers. The law requires me to only reveal a patient’s information to the patient or the patient’s legally authorized representative. Therefore, I always ask the patient if they have a legal representative when attending to them in the ED (Clayton et al., 2023). However, challenges arise when a patient is brought in an unconscious state and there are no records of who their legal representative is. Furthermore, some relatives become aggressive when we insist that we cannot inform them of their patient’s condition if the disclosure is not authorized by the patient or the patient’s legal representative.
3. Briefly describe at least two examples of legislative oversight that affect your nursing practice.
Legislative oversight in Texas
An example of State legislative oversight in Texas that impact nursing practice is the Transition Oversight Committee Transition Legislative Oversight Committee (TLOC). TLOC is responsible for overseeing consolidation efforts. A national legislative oversight includes the Oversight of the Department of Health and Human Services. It is tasked with protecting the integrity of Health and Human Services (HHS) programs and the health and welfare of program beneficiaries (Porche, 2021).
